1. Overview

This website is operated by Lazarus Risen LLC, a Georgia limited liability company ("Lazarus Risen," "we," "us," or "our"). These Terms of Service ("Terms") apply to everyone who visits our website, buys from us, or signs up for our text messages or emails.

By using our site, placing an order, or joining our SMS or email list, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site or our services.

Our store runs on Shopify. Shopify provides the platform that hosts our site and processes payments.

2. Using our store

Age. You must be at least 18, or the age of majority where you live, to place an order. If you are younger, a parent or guardian must place the order and agree to these Terms.

Accurate information. You agree to give us complete and accurate contact, shipping, and payment information. You are responsible for any account you create and for keeping your login details private.

Products. We try to show our products' colors, embroidery, and details as accurately as possible. Colors may look slightly different depending on your screen, and embroidered and appliqued items may vary slightly from piece to piece.

Pricing. Prices are listed in US dollars and may change at any time before you place an order. If a price or product is listed in error, we may cancel the affected order and refund you in full.

Order acceptance. We may limit quantities, refuse, or cancel any order, including orders that appear fraudulent or exceed a per-customer limit. If we cancel an order you paid for, we will refund you in full.

3. Pre-orders (when offered)

From time to time we may offer some products as pre-orders. A pre-order means you pay now for an item that has not been produced yet. This section applies only to items clearly labeled as pre-orders.

Payment. You are charged the full price, plus shipping and any taxes, when you place a pre-order.

Production. Pre-order items go into production after the pre-order window closes. Each pre-order product page will show the pre-order window and the estimated ship date.

Estimated dates. Ship dates are estimates, not guarantees. Manufacturing and shipping delays can happen. If your order will not ship by the date we stated, we will email you a revised date and give you the choice to cancel for a full refund.

Minimum orders. If a pre-order run does not reach the quantity needed for production, we may cancel the run and refund every customer in full.

Cancelling your pre-order. You can cancel for a full refund any time before the pre-order window closes by emailing lazarusrisenllc@gmail.com with your order number. After the window closes, production is paid for and your item is made to order, so cancellations are not accepted, except in the delay situation described above.

Sizing. Please check the size chart before ordering. We order production quantities by size, so size changes are only possible before the pre-order window closes.

4. Shipping, returns, and exchanges

Shipping. We currently ship within the United States [CHANGE IF YOU SHIP INTERNATIONALLY]. Shipping costs and options are shown at checkout. Once your order ships, you will receive tracking information by email or text.

Lost or stolen packages. Please make sure your shipping address is correct. We are not responsible for packages lost or stolen after the carrier marks them delivered, but we will help you file a claim with the carrier.

Damaged or defective items. If your item arrives damaged, defective, or wrong, email lazarusrisenllc@gmail.com within 14 days of delivery with your order number and photos. We will replace the item or refund you, at our choice and based on availability.

Returns. Unworn, unwashed items with tags attached may be returned within 14 days of delivery for a refund of the item price, minus original shipping. Email us before sending anything back. Pre-order items and items marked final sale cannot be returned unless they are damaged, defective, or incorrect, because they are made in limited quantities based on the orders we receive.

Exchanges. Size exchanges after delivery depend on leftover stock and are not guaranteed. Contact us and we will do our best to help.

5. SMS and email marketing

Program. By entering your phone number and checking the consent box on our sign-up form or at checkout, you agree to receive recurring automated marketing text messages from Lazarus Risen at the number you provided. Messages may include product launches, pre-order and early-access alerts, restocks, and offers.

Consent is not required to buy. Signing up for texts is not a condition of any purchase.

Frequency and cost. Message frequency varies. Message and data rates may apply according to your mobile plan.

Opting out. Reply STOP to any message to unsubscribe. You will receive one final message confirming you are unsubscribed, and no further marketing texts after that. You can rejoin any time by signing up again.

Help. Reply HELP for help, or email lazarusrisenllc@gmail.com.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Your information. We will not sell or share your mobile number or SMS consent with third parties for their own marketing. Details are in our Privacy Policy.

Email. If you join our email list, every marketing email will include an unsubscribe link. Order confirmations and shipping updates are transactional and may still be sent after you unsubscribe from marketing.

6. Our content and your use of the site

Our designs. The Lazarus Risen name, logos, designs, embroidery artwork, photos, videos, and text on this site belong to us or are used with permission. You may not copy, reproduce, sell, or use them without our written permission.

Prohibited uses. You agree not to use our site to break any law, infringe anyone's rights, upload harmful code, scrape or collect data from the site, interfere with its security, or submit false or fraudulent orders.

Your submissions. If you send us reviews, photos, or comments, or tag us on social media, you give us permission to share that content to promote Lazarus Risen, with credit to you where practical. You confirm you have the right to share what you send.

Third-party links. Our site may link to other websites or services, such as social media or payment providers. We are not responsible for their content or practices.

7. Disclaimers and limits of liability

As-is. Our site and products are provided "as is" and "as available." To the extent the law allows, we make no warranties beyond those stated in these Terms.

Limit of liability. To the fullest extent the law allows, Lazarus Risen and its owners will not be liable for indirect, incidental, or consequential damages from your use of the site or our products. Our total liability for any claim will not exceed the amount you paid for the order involved.

Indemnification. You agree to protect Lazarus Risen and its owners from claims, losses, and costs, including reasonable attorney fees, that result from your breach of these Terms or your misuse of the site.

Product care. Follow the care instructions on the label. We are not responsible for damage caused by washing, drying, or using an item in ways the label advises against.

8. Governing law, changes, and contact

Governing law. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Bartow County, Georgia, unless the law requires otherwise.

Severability. If any part of these Terms is found unenforceable, the rest stays in effect.

Changes. We may update these Terms at any time by posting the new version on this page. Changes apply to orders placed and messages sent after the update date. Orders already placed follow the Terms in effect when you ordered.
